Trusts Asset Management
Trusts are the basic management structure with respect to wealth accumulation. They are promoted widely. At Mackenzie Elvin we have real concerns about the "one size fits all" approach. The foundational Trust Deed must reflect and provide for your situation and circumstances. The set up is only part of the process. We are part of a collection of professionals able to provide professional and independent review, management and investment strategy régimes.

Employment
The Employment Relations Act 2000 took effect on 2 October 2000. The Act seeks to minimise judicial intervention in the early stages of dispute resolution by promoting "good faith" collective bargaining and by providing for mediation as the preferred method of dispute resolution. The Employment Tribunal is replaced by the Employment Relations Authority which will have investigative powers. The Employment Court can hear appeals from the Authority.

The stated objects of the Act are to:

  • recognise that employment relationships must be built on "good faith" behaviour
  • acknowledge and address the inherent inequality of bargaining power in employment relationships
  • promote collective bargaining
  • promote mediation as the primary problem-solving mechanism; and
  • reduce the need for judicial intervention.

The new law is complex and while the focus is on good faith bargaining, there is concern that as a result of the legislation we will see the re-unionism of the work force. There are significant implications for many industries, particularly our local kiwifruit industry and hospitality/restaurant industries. We have checklists available dealing with issues to be addressed in collective and individual agreements. Please contact us.
